USA Today has requested Winter in America photographs from around the country. 

The following are the guidelines and the entry that we just submitted for Maryland.

Please send us a winter photo from your area. We'll select the best to appear in On Deadline.

A few guidelines:

1. Please submit only one photo.

2. It must be from this winter, and it must be your original work on which you control all the rights.

3. Include a sentence or two of description about where the photo was taken.

Our submission:

We live in Gaithersburg, Maryland, in Montgomery County, in the suburbs of Washington, DC.  So far, we have enjoyed a very mild winter with very little snow.  At this time last year we had a major snow storm.

December colors in Kentlands.  This photograph was taken on December 11, 2011 and is one of the final roses of the season in Kentlands in Gaithersburg, Maryland. The location is Thaxton Street, in our home neighborhood.

Don't Let a Little Crack Delay Your Home Settlement

Real estate appraiser and ActiveRain blogger Michael Bolton offers some practical advice for those that find cracked windows in homes that are under contract.

This issue can be more complicated for windows where individual panes cannot be replaced. Sometimes, the whole sash need to be first ordered to fit and then installed.

One of the major challenges Realtors face when having one of their sales go FHA financing, is what work orders is the appraiser going to call for. With Fannie Mae and Freddie Mac in everyone's crosshairs, FHA financing is only going to become more prevalent within the housing market. I would highly recommend that Realtors become familar with HUD's Mortgagee Letter 2005-48, and FHA's three S's.

 

Small Window Cracks Don’t Need Repair

FHA no longer requires that all cracked or broken windows be an automatic repair. Requiring a window to be repaired can be challenging for an appraiser, because what is considered safe and just a maintenance item for one appraiser, may be considered a danger to another. FHA requires that all deferred maintenance be noted within the appraisal report, along with a photo, so the underwriter can make the final decision if it’s in doubt. This window has such a small crack that it wasn't probably worth mentioning, but I did anyways just to CYA. The underwriter agreed, and no repair was necessary.


Some Window Cracks That May Need Repair

It's tough to see, but this crack is much larger, however, it was dual pane glass and the owner could operate the window without getting hurt. That doesn't mean that someone on the outside touching or moving the window wouldn't get injured. On this appraisal I just reported it to the underwriter; "That this window has the potential for injury," and let them make the call. The underwriter ended up requiring the window to be repaired.


The Obvious Window Cracks That Should Be Repaired

This window is pretty much a no-brainer, and would be required to be repaired. It doesn't meet FHA's MPR (minimum property requirements) guidelines, which is to protect the improvement (house) from the outside elements, and the safety of the homeowner. However, the underwriter does have the final say, but most likely will require that it be repaired.


The bottom line is that if you have any window that is cracked or broken, and has the appearance of being a safety hazard, have it repaired before listing the property for sale. This will keep your sale from being delayed at the last minute by an FHA work order.

Joe Johnson, WSSC Chief Superintendent for Potomac Water Treatment Plant is the guest speaker to discuss our drinking water. Prompted by the fact that Montgomery and Prince George's counties have a sanitary sewer system as opposed to Washington DC's combined sewer system.  This in turn means WSSC is not responsible for storm water because storm water does not enter WSSC's sanitary sewer system. But the Potomac Water Treatment Plant does have an intake in the Potomac River-below Muddy Branch.  So, some argue we are drinking what comes off our lawns. Please join the GO GREEN Group and Muddy Branch Alliance for what is sure to be an informative, engaging discussion.

8 Steps to Better Blogging and SEO

Follow these 8 blogging tips for better SEO ranking so your blog soars to the top of page one on  Google:

1. Keep track of your word count. A good blog should be between 300 – 500 words. Too short and you won’t have enough content, too long and not only will you lose your readers, but Google too! Seems we both have short attention spans!

2. Repeat your keywords or key phrase so they make up 1-4% of your content. This is really important for Google and other search engines to find you.  

3. Instead of repeating your key phase over and over making your content repetitive, hide your keywords behind a picture. After inserting your picture there’s a box at the bottom called: Title.  Add your keywords and title here.

4. To increase your website's ranking have at least 2 links going to your website. Make sure they go to different pages. For example my website has 5 pages (Home page, Portfolio, Staging FAQs, ect. so I link my posts to at least 2, but sometimes all 5 pages.

5. Use Bold and Underline relevant words – your key phrases and keywords. Again Google see this and it helps your ranking.

6. We all like catchy titles but they aren’t always the best for optimum SEO. You want to be geographically specific, concise and short with your keywords in the Title.

 

7. You want your content and title to complement each other. (i.e if my keywords are Staging Morris Plains, NJ with Before/After Photos” I want to reinforce and repeat “Staging Morris Plains, NJ throughout my blog. Keep it local and stay on topic for your readers and better SEO ranking.

 

8. Don’t forget Hyper-Local content. Write about your neighborhood’s happenings, events, restaurants and be specific so your target audience finds you!

We have another beautiful day in Maryland and the conditions were ideal for my morning walk through Kentlands and Lakelands in Gaithersburg.

It is good to have photographs to help us remember other January days that were somewhat different.  At this time last year, we were still digging out of deep snow.  It is fun to take photographs with deep snow but life is much easier with good weather.

Undue Influence - Who gets the family farm?

The Texas Tenth Court of Appeals recently decided a case of a will contest that involved an allegation of undue influence.

The case styled In the Estate of Doris Irene Ward, deceased, involved Doris Ward, her husband Bobby Ward, and Dwana Phillips, Doris's daughter from her first marriage. Dwana was close to Doris; the two ladies talked on the telephone frequently and visited almost every day. Doris suffered from Parkinson's disease and had other health issues. In early 2009, after a brief hospital stay, Doris entered a skilled nursing facility where she resided until her death on March 21, 2009.

On April 17, 2009, Bobby filed an application to probate a will that Doris had executed on December 11, 2008, and he requested appointment as the executor of her estate. The will stated that Doris left all of her real property to Bobby upon her death. This included a seventy-seven acre tract of land that Doris had inherited from her parents. The trial court admitted Doris's will to probate and appointed Bobby as the executor pursuant to the will.

Dwana filed a lawsuit challenging the will, alleging that Doris's will was executed as the result of undue influence exerted by Bobby. She also alleged that the will contained a mistake regarding the disposition of the seventy-seven acre tract of land commonly referred to as the family farm. Dwana testified at trial that Doris had conveyed the seventy-seven acre family farm to her in a handwritten deed, and Dwana asked the court to declare the rights of the parties under the deed. She said that Doris left the deed on Doris's kitchen table before Doris and Bobby went on a trip to Europe. Bobby saw the deed and admitted that it did reference the family farm. After Doris and Bobby left for Europe, Dwana saw the deed on the kitchen table and read it. Dwana understood that the document meant that Doris was conveying the family farm to her. After Doris and Bobby returned from their trip, the document was destroyed. Bobby testified that Doris had intended to give Dwana the family farm, but that she changed her mind and shredded the document. Several witnesses testified regarding the existence and delivery of the deed.

With regard to whether Bobby exerted undue influence over Doris in the execution of the will, the evidence presented to the jury showed that by late 2008, Doris was taking over 20 different medications, and relied heavily on Bobby. The evidence also included a Texas Department of Family and Protective Services report regarding allegations of abuse and the medical neglect of Doris by Bobby. Other evidence included medical records from the nursing home referencing comments by Doris that she was scared of Bobby, did not want Bobby to take her home, that Bobby had choked her, and that he was aggressive and verbally abusive toward her. Additionally, Bobby was present at every meeting with the lawyer regarding the drafting and execution of the will. At the time Doris executed the will, she was unable to read or drive, and she could not walk without assistance.

At the conclusion of the trial, the jury determined that Doris had signed a deed to the family farm, and had delivered the deed to Dwana. The jury also determined that Bobby exerted undue influence over Doris in the execution of the will. The trial court entered its final judgment adopting the jury's findings that denied Bobby's request to probate the will that conveyed him the family farm. Bobby filed an appeal for a new trial and judgment notwithstanding the verdict. The motions were denied, and Bobby appealed that ruling.

The Texas appellate court began its analysis by stating that under Texas law, to establish undue influence, a party must prove: "(1) the existence and exertion of influence; (2) the effective operation of an influence so as to subvert the will or overpower the mind of the grantor at the time of the execution; and (3) the execution of an instrument the maker would not have executed but for such influence." There must be sufficient evidence to show that influence was present and was exerted in executing the will. The appellate reviewed the evidence from the trial and concluded that there was "legally sufficient evidence to support the jury's finding that Bobby exerted undue influence over Doris, at a time when her health and mental capabilities were failing, to subvert Doris's intention to give the family farm to Dwana and that the provisions of the will bequeathing the family farm to Bobby would not have happened but for Bobby's undue influence." With regard to the deed, the Court determined that "there is legally sufficient evidence to indicate that Doris, the grantor, handwrote a deed conveying the family farm to Dwana, the grantee; that it was Doris's intent that Dwana receive the family farm; and that Doris delivered the deed, as defined by the charge, to Dwana." The appellate affirmed the judgment of the trial court.
